1. Approved position, area and range:
Areas extending 3 nautical miles seaward from the mean low tide line along the coast of Linyuan District, Kaohsiung City (Base Point A59: 22o30.46’N, 120o21.64’E; Base Point A58: 22o28.45’N, 120o19.07’E; Base Point A56: 22o25.93’N, 120o23.36’E; Base Point A57: 22o28.68’N, 120o25.45’E; Base Point A571: 22o28.53’N, 120o25.05’E), but not including oil offloading buoy off Dalinpu of Kaohsiung Harbor No.2 as well as its navigating and anchor banning terrains, and port areas and their navigational passages. (Attachment 1 chart of fishing ground, Attachment 2 Coordinates in Longitudes and Latitudes of range of areas not included.)2. Approved area: 39.6 square kilometers
3. Approved Duration: 19 April 2000 to 18 April 2020
4. Approved types of fisheries: longline fishery, gill-net fishery, push net fishery, and hook and line fishery
5. Restrictions or affiliated conditions:
(1) Under the principle of taken from the public and used by the public, holder of the fishing right shall allocate 100% access fee, for full input to the management and building of fishing ground, and implemented in accordance with the conditions set forth in Attachment 3.
(2) Holder of fishing right shall carry out conservation of resources and preservation of the marine environment in accordance with the rules prescribed in the business plan, and provide annual report in writing on every 31 January. Upon review of the Council of Agriculture (in principle, performed bi-annually), in case the approved conditions prescribed in the Attachment have not been performed, the exclusive fishing right license shall be subject to revocation in whole or in part in accordance with the Administrative Procedure Act, article 123, and the holder shall have no right to request for recourse.
(3) Approved scope of exclusive fishing right, precluding the use of the following sea areas which have been duly publicized:
i. Port areas and their navigational passages of naval ports, commercial ports, ports for exclusive use, fishing ports, and marinas.
ii. Areas of national parks.
iii. Areas which have been occupied but have completed exclusive fishing right compensation.
iv. Areas where mining rights were approved in accordance with the Mining Act, and are still effective.
v. Any areas for exclusive use which have been publicized by the central or local government in accordance with the applicable law.
(4) In areas prescribed as follows, for joint use, the operations of exclusive fishing right are to be conducted under restrictions or the conditions as set forth in the Attachment, and the holder of the exclusive fishing right shall have no right of recourse:
i. All kinds of protected areas (such as marine protected areas, coral reef protected areas), natural reserves, artificial reef areas and wetlands, which have been publicized by the government according to law.
ii. Areas where facilities are already in existence: such as fuel oil offloading buoys at sea, water inlet and outlet vents of power plants, etc.
iii. Areas publicized by the government according to law, for specific uses, while not prohibiting fishing activities.

Areas extending 3 nautical miles seaward from the mean low tide line along the coast of Qieding District, Kaohsiung City (Base Point A616: 22o50.90’N, 120o11.59’E; Base Point A615: 22o49.79’N, 120o08.57’E; Base Point A62: 22o53.03’N, 120o07.71’E; Base Point A63: 22o54.74’N, 120o10.55’E), but not including coal offloading system of Xingda Power Plant, port areas and their navigational passages, and other exclusive areas as announced by the government according to law. (Attachment 1 chart of fishing ground, Attachment 2 Coordinates in Longitudes and Latitudes of range of areas not included.)2. Approved area: 38 square kilometers
3. Approved Duration: 17 June 2011 to 16 June 2021

Areas extending 3 nautical miles seaward from the mean low tide line along the coast of Yung’an District, Kaohsiung City (Base Point A613: 22o47.04’N, 120o9.74’E; Base Point A614: 22o48.21’N, 120o12.76’E; Base Point A615: 22o49.79’N, 120o8.57’E; Base Point A616: 22o50.9’N, 120o11.59’E), but not including operation area of coal offloading pier of Xingda Power Plant, operation area of Yung’an LNG receiving pier of China Petroleum Corporation Taiwan, coastal reclaimed land of Yung’an Villiage (south reclamation and construction area), port areas and their navigational passages, and other exclusive areas as announced by the government according to law. (6) Principles in dealing with matters involving Taiwan Strait Mine Areas 1 and 2 of China Petroleum Corporation of Taiwan by the exclusive fishing right: The exclusive fishing right and mining right will co-exist. In case of approving exclusive mining right in the area of exclusive fishing right, article 29 of the Fisheries Act shall apply.
